Terms and Conditions

These Terms and Conditions govern your use of amtdigital.com.au and the services provided by AMT Digital. By engaging our services or using our website you agree to these terms.
AMT Digital is a sole trader business operated by Andrew, based in Sydney, Australia.
1. Services
AMT Digital provides WordPress website hosting and maintenance services as described on our website. The specific inclusions of each engagement are confirmed at the time of onboarding.
We reserve the right to decline to provide services to any person or business at our discretion.
2. Pricing and payment
Our standard management plan is $249 AUD per month. Pricing for WooCommerce, complex or custom builds is provided by individual quote.
Invoices are issued monthly in advance via Zoho Invoice. Payment is due within 14 days of the invoice date. We reserve the right to suspend services on accounts more than 14 days overdue.
Prices are in Australian dollars and inclusive of GST where applicable.
3. No lock-in contract
There is no minimum contract period. Either party may terminate the arrangement with 30 days written notice. We will not charge for the period after notice is given and services have ceased.
4. What is included
The standard management plan includes the services listed on our website at the time of your engagement. These may change over time. We will notify you of any material changes to inclusions with reasonable notice.
Content updates are limited to two hours per month. Additional time is available at our standard hourly rate, agreed in advance.
5. What is not included
The following are not included in the standard management plan unless separately agreed:
- New website builds or redesigns
- WooCommerce or complex functionality development
- Third-party plugin or software licence fees
- Domain name registration or renewal
- Content creation, copywriting or graphic design
- Emergency after-hours support outside business hours
6. Client responsibilities
You agree to:
- Provide accurate information when requested
- Respond to communications within a reasonable timeframe
- Maintain ownership of your domain name and any third-party accounts associated with your site
- Not use your website for unlawful purposes
We are not responsible for issues arising from your failure to respond to time-sensitive requests, such as domain renewals or security notices.
7. Backups
We maintain daily off-site backups with 30-day retention as part of the standard plan. While we take reasonable care with backups, we recommend you maintain your own independent copies of critical website content and data. We are not liable for data loss beyond what can be recovered from our backup retention period.
8. Uptime
We target 99.9% uptime for hosted websites. This target excludes scheduled maintenance windows, events outside our reasonable control, and downtime caused by third-party services including domain registrars, DNS providers, and Cloudflare.
9. Security
We implement reasonable security measures including firewalls, malware scanning and monitoring. However, no system can be guaranteed secure. We will notify you promptly if we become aware of a security incident affecting your website.
We are not liable for losses arising from security incidents that occur despite reasonable precautions being in place.
10. Limitation of liability
To the maximum extent permitted by Australian law, AMT Digital is not liable for:
- Loss of revenue, profits or business arising from website downtime or technical issues
- Indirect or consequential loss of any kind
- Loss arising from third-party service failures including hosting infrastructure, domain registrars, or plugin developers
Our total liability in any circumstance is limited to the amount paid by you in the three months preceding the event giving rise to the claim.
11. Intellectual property
Any custom code or theme work developed specifically for you as part of a paid engagement becomes your property upon full payment. Off-the-shelf plugins, themes and software remain subject to their own licences.
AMT Digital retains the right to describe the nature of work completed for you in general terms for portfolio or marketing purposes, without disclosing confidential information.
12. Termination
Either party may terminate with 30 days written notice as described in clause 3. We reserve the right to terminate immediately and without refund in the event of:
- Non-payment after reasonable notice
- Use of services for unlawful purposes
- Abusive or threatening behaviour toward us
13. Governing law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
14. Changes to these terms
We may update these terms from time to time. We will notify existing clients of material changes. Continued use of our services after notice of changes constitutes acceptance of the updated terms.
